Right of First Sale Apply to iTunes Songs?

Copyright /. and 90% Crud report that a man has put up an iTunes song on eBay. Does the right of first sale exist here? (Right now, the tune is at $360!)

    The auction now stands at $16,600. The seller has stated that he would like to withhold some of the donation to cover eBay costs, but the rest is going to EFF.

    It appears that the auction has been deleted from eBay. Trying to get there returns "The item you requested ( 2555673237 ) is invalid, still pending, or no longer in our database."
