Here's a legal question. I sent a letter to SCO to send me proof that they own Linux. That was several weeks ago. They have not replied. Now should they sue me because I run Linux, can I use that as a defense? I sent them a letter querying about the legal status of Linux and since they failed to reply, they have no grounds to sue me. Would it work?

I think you should ask them again, and give them a specific timeframe to respond. Mention also that if you do not hear from them, you'll consider they admitted their claim to be witout foundation.
I think it is called estoppel...
