AOL Must Reveal Anonymous Poster's Identity

privacy Derek writes "AOL must reveal an anonymous subscriber's identity in a suit filed by a Hong Kong electronics firm alleging libel and unfair business practices. The Virginia Supreme Court held that the First Amendment defenses raised by AOL (regarding anonymous speech) did not apply to the unfair business practices claim."

    It is my understanding that the suit was brought in California, and appealed in Virginia.

    I believe that the Virginia court only ruled on the change of venue, and not on the lower court's decision. The Virginia court left it up to AOL to file an appeal in California. I do not believe that the Virginia court even considered the Constitutional issues. They never got that far.
