BuyMusic.com's Ads Too Similar to Apple's?

Copyright Wired: BuyMusic.com has started to mimic Apple's ads. Apple could choose to fight back, as copyright law provides protection for an expression of an idea, but not for the idea itself. A "substantial similarity" between the two ads that could be used "at least as a valuable argument" for a copyright-infringement lawsuit, said Robyn Crowther, an IP attorney at Caldwell, Leslie, Newcombe & Pettit.

"The dichotomy between 'ideas' and 'expression' is hard to get across," said Blaney Harper, an intellectual property attorney at Jones Day. "Showing average people air guitaring their way through a song against a white background" [is not enough to show BuyMusic is copying Apple's expression.] The fair-use doctrine does provide a defense to copyright- and trademark-infringement claims. The critical issue will be whether the BuyMusic.com is a parody of the Apple ads."

    It's worthwhile to highlight that Apple could also claim trademark infringement; customers seem to associate the white background and air guitar w/ Apple.

    Because Buymusic is trying to sell music along with Apple, I envision they'd have a very difficult time claiming parody; their aim isn't a comment on apple as much as an effort to earn money. I haven't seen the ads, but I doubt they have a strong argument along the comparison lines either.

    What buymusic really needs is a reason that they aired similar ads. For their sake, I hope they have market research that indicates (pre-Apple's version) that these would be good ads, because, imho, they seem to have chosen this to trade on the goodwill that iTunes has developed, and that is exactly what trademarks are designed to stop.
