The Swedish proposal for an adaptation of the European Copyright Directive (EUCD / Infosoc), 2001/29/EC, was presented today by the Swedish departement of justice. The directive, like the U.S. Digital Millenium Copyright Act, is based on the Wipo Copyright Treaty and the Wipo Performances and Phonograms Treaty.
Some things in the proposal that will affect the current Copyright Act:
* Protection against circumvention of technological measures to protect works.
* Private copying is limited in comparison to the current Copyright Act.
* Levies are introduced for certain digital products.
* Introduction of contractual, organisational licenses for certain works (very Swedish construction, depending on the existence of well-functioning collecting societies, not very common abroad).
The proposal will be considered by all parties touched by the proposal (100 entities are identified by the departement of justice, but private individuals may also issue replies). The departement of justice will take the responses into account, file a new proposal with the legislative council and then send it to the Swedish parliament for legislation. The law is supposed to enter into effect January 1, 2004.
