Leiber, Stoller, Sue Bertelsmann Over Napster

Copyright A group of music publishers including Jerry Leiber and Mike Stoller, writers of "Jailhouse Rock," have filed a complaint against the German media company Bertelsmann. Stoller and Leiber hope to represent a wide array of music publishers including the Harry Fox Agency in asserting that Bertelsmann, through its late investment in Napster (during the trial) was also a contributory and vicarious infringer. They claim that Bertelsmann was fully aware of how its actions helped Napster's users to infringe on their copyrights and that Bertelsmann had the power to shut the service down and stop the illegal behavior.

This seems to be an interesting almost secondary contribututory infringement suit. Bertelsmann contributed to Napster, who contributed to the infringement of Napster users.
