News Jennifer Farrell writes "In the decision of the High Court of Australia in Dow Jones v Gutnick [2002] HCA 56 the Court dismissed the application by Dow Jones to prevent the defamation action proceeding in an Australian jurisdiction. It was held that Victoria was the appropriate forum for the defamation litigation. Justice Callinan considered that Dow Jones sought to impose on Australian residents “an American legal hegemony in relation to Internet publications”. While the results, according to Justice Kirby called for an "international discussion in a forum as global as the Internet itself”."
