European scholars now seem to enter the international debate on fair use versus content control. The Register is running an interesting debate on the UK implementation of the EU Copyright Directive. In an opening remark Brian Esler argued an exception in the copyright proprietor's right to control access to content to be "obscence".
In a reply Laurence Kaye argues in opposite direction:

"Rights owners are not in the business of locking up content. They exist in order to encourage creativity and to provide the means to enjoy it.
Copyright law has always been about a balance between rights and exceptions."
