Judge Richard Owen dismissed all claims made by owners of several Times Square buildings and billboard companies against Columbia Pictures (owned by Sony) with prejudice in Sherwood 48 Associates v. Sony Corporation of America, 02 Civ. 2746. The plaintiffs argued that Columbia by superimposing advertisements on billboards that appear in "Spider-Man" and its trailers had infringed trademarks, indulged in unfair competition and - deep breath - trespassed on the plaintiff's property by using laser technology to digitally film the building.
Tom Perrotta of New York Law Journal has the entire story.
