Jeremy Malcolm writes "One of Australia's most prominent email marketers has sued a local Internet user who is alleged to have reported the spam to a non-profit blocklist service, SPEWS. The defendant denies he did so - SPEWS does not accept complaints from the public - but in any case denies that causing the spammer to be listed on a voluntary blocklist is legally actionable. More information is available online." This dispute follows several others relating to email spam services. However, all prior cases have dealt with a spammer suing the service, and not individuals reporting spam to that services. This marks a rather drastic, and seemingly futile, change in course.
