MoFo Replies to Spam E-Mail With Lawsuit

News Morrison & Foerster is suing Etracks.com, under California law, for overwhelming the firm and its employees with spam (bulk e-mail). The state statute prohibits sending commercial e-mail when the marketer has not developed a relationship with the user and the recipient has not specifically requested the email. Seeking damages of $50 per message, up to $25,000 per day, MoFo also accused Etracks of failing to adhere to another statute that requires commercial e-mail include "ADV:" in the subject field. The email marketer also allegedly sent an additional 6500 spam messages after receiving notice of MoFo's policy against unsolicited email. Etracks denies the charges, claiming that one or more of MoFo's employees probably signed up to receive information from one of marketer's clients, such as Conde Nast and Office Depot.
