Employer Ownership of Inventions Upheld

News hardpack writes "Computer programmer Evan Brown loses his appeal against his former employer, Alcatel USA (then DSC Communications). Brown states that he had thought of a novel software design idea on his own time while at Alcatel, and, when he refused to disclose the idea upon Alcatel's request, Alcatel fired him. His claim is that the employee contract to disclose any inventions is not binding and is "unconscionable;" furthermore, he claims that his idea is not yet a full concept and not yet an invention--it was just an idea in his head and not documented in any way. The Texas Court of Appeals upheld the validity of the employee contract and overruled on whether Brown could prove the status of his idea. Brown has published the text of the Court opinion."
