Stephan Ott writes "Last year the highest German
civil court found that deep
links are legal (text
of decision). This year, the court once again stressed the importance of
hyperlinks and provided a long awaited decision on the liabilty for hyperlinks
to illegal content: As long as it is not
obvious that the linked-to-site is involved in illegal activities, website
operators are protected by the freedom of press or opinion and may not be held
liable for providing hyperlinks. The decision generated a lot of buzz in Germany
and abroad. German news
sources welcome the verdict as necessary limitation of the liability of
website operators. "
