Criminal Law Anita Ramasastry's take on why the CAN Spam Law won't work: not all spam is prohibited; under federal law, individuals can't sue spammers; overseas spammers outside of US jurisdiction; and the Do Not Spam Registry may be subject to First Amendment challenge."

    It fails to specify clearly what types of opt-out links are allowed. We all know that those links are often broken or subject the user to a bazillion pop-up ads. Just how many layers of pop-ups and click-throughs are allowed? The law destroys several stronger state anti-spam laws.
