Buck Mulligan writes "The US Sentencing Commission has issued a notice that the agency will consider new penalties for hackers. The notice is on the USSC page. This reconsideration of penalties is required by the Homeland Security Act, which included language attached by Lamar Smith (R-TX) from the Cyberspace Security Enhancement Act."
