Jon Johansen Acquitted

Copyright Digi.no reports that Jon Johansen has been acquitted.

The Norweigan "Byrett" (district court) tried the Jon Johansen DVD case on December 9, 2002. The trial was supposed to take place the summer of 2002, but the court decided to postpone the trial to find a technology savvy judge. The case will be tried by one judge and a panel of two lay assessors.

Jon Johansen was prosecuted by the Norwegian Economic Crime Unit (OKOKRIM) under Norwegian Criminal Code 145(2). Johansen took some part in the creation of the DeCSS software that can enable DVD playback on Linux. It was argued that the DeCSS software is a piracy tool.

    This is fantastic news. I think this precedent will be very important to other International courts who will undoubtedly be seeing similar cases in the future. More imporantly, this victory represents an incredible waste of money and effort on behalf of the MPAA -- way to go guys!

    Now if we can get some more sanity of the California and U.S. federal courts, we'll be well on our way to once again having protected fair use rights in the U.S. As the media industry has fallen so many times before in trying to stiffle the consumer, it appears that such currents may once again prevail. I can't wait until a digital copyright case gets to the U.S. Supremes.

    The law is about to be changed. Norway will follow the European Union and the European Copyright Directive and implement a version of the WIPO Copyright Treaty, that also served as inspiration for the U.S. Digital Millenium Copyright Act.
