Google Loses First Domain Round

Digi.no reports that American search engine Google lost the first round in an ongoing battle over Google.no. Google, Inc. sued Google.no proprietor Norweigan company SMSfun on grounds of trademark infringement and breach of the marketing law. Google, Inc. registered Google as a Norweigan trademark in December 2001, while SMSfun registered Google.no as a domain name in February 2001.
In an interim decision delivered last week, Oslo Namsrett ruled in favour of SMSfun. Oslo Namsrett states in its ruling that Google, Inc. has not been able to been able to show risk of substantial damage or defamation, should SMSfun not immediately discontinue its services. Hence, SMSfun may continue using Google.no until the case can be fully tried and investigated in about a year.
SMSfun has published their version of the story online in Norweigan. According to this account SMSfun registered the domain name to market sun-glasses. At Google.no you may order a pair of black shades with "google.no" inprinted in white on the sides.
